1. GENERAL PROVISIONS

1.1. These terms and conditions of sale (hereinafter - the Terms) establish the mutual rights, obligations and liability of the person acquiring products in the online store www.gamebound.lt (hereinafter - the Buyer) and Dvitex MB (hereinafter - the Seller).

1.3. The right to buy in the online store is held by legally capable natural persons, minors from 14 to 18 years of age only with the consent of their parents or guardians, and legal persons.

1.4. By placing an order, the Buyer confirms that they have read these Terms and agree with them.

1.5. The Seller has the right to change the Terms. An order is subject to the version of the Terms that was in force at the time the order was placed.

2. CONCLUSION OF THE PURCHASE-SALE CONTRACT

2.1. The contract between the Buyer and the Seller is considered concluded from the moment the Buyer forms the shopping cart, indicates the delivery address, chooses the payment method, reads these Terms and presses the “Order” button (the button is marked with the note “order with an obligation to pay”).

2.2. Upon conclusion of the contract, the range of products indicated in the Buyer's order, their quantity, price, delivery term and other conditions become binding on both parties.

2.3. Every contract is stored in the online store. Confirmation of the order is sent to the email address indicated by the Buyer.

2.4. The Seller has the right to refuse to conclude the contract if the product is sold out, an obvious price error has occurred, or there are reasonable doubts about the authenticity of the order. In such a case the amount paid is refunded within 5 (five) business days.

3. RIGHTS AND OBLIGATIONS OF THE BUYER

3.1. The Buyer has the right to buy products in the manner established by these Terms.

3.2. The Buyer has the right to withdraw from the contract within 14 (fourteen) days without giving a reason. The return procedure is described in section 7.

3.3. The Buyer must pay for the products and accept them in the manner established by these Terms.

3.4. The Buyer must provide correct data. The Seller is not liable for consequences arising from incorrect data provided by the Buyer.

4. RIGHTS AND OBLIGATIONS OF THE SELLER

4.1. The Seller undertakes to provide the conditions for using the services of the online store.

4.2. The Seller undertakes to deliver the products ordered by the Buyer to the indicated address.

4.3. Should important circumstances arise, the Seller may temporarily or entirely terminate the activity of the online store without giving prior notice.

4.4. The Seller undertakes to respect the Buyer's privacy and to process personal data in accordance with the Privacy Policy.

5. PRICES OF PRODUCTS AND PAYMENT

5.1. Prices of products are indicated in euros. The Seller is not a VAT payer, therefore VAT is not calculated and is not separated out in the prices. The delivery price is indicated separately when the order is being formed.

5.2. When a discount is applied, the lowest price of the product that was in force during the last 30 (thirty) days before the start of the discount is indicated next to the discounted price.

5.3. Payment methods:

payment initiation service (bank link) via Montonio;
payment card (Visa, Mastercard), Apple Pay, Google Pay via Montonio.

5.4. Payment services are provided by Montonio. The Seller does not store the Buyer's payment card data.

5.5. An order is only started once payment has been received. If payment is not received within 48 hours, the order is cancelled.

5.6. The invoice is provided electronically to the email address indicated by the Buyer. The Seller does not issue VAT invoices, as it is not a VAT payer.

6. DELIVERY OF PRODUCTS

6.1. Products are delivered within the territory of the Republic of Lithuania.

6.2. Delivery methods and prices:

to a parcel locker (Omniva, Unisend, SmartPosti) - from 2.49 EUR;
by courier to the indicated address - 3.99 EUR;
collection by prior arrangement - free of charge.

6.3. Products are dispatched within 1 business day of receiving payment, if the product is in stock. If the product is not in stock, the Buyer is informed separately.

6.4. Delivery terms are approximate and do not apply in cases where the required products are not in the Seller's warehouse or the delay occurs due to circumstances beyond the Seller's control.

6.5. When accepting the parcel, the Buyer must check the condition of the packaging. If damage is noticed, it must be noted on the delivery document or a report must be drawn up. If this is not done, the Seller is released from liability for damage to the products whose cause is not a manufacturing defect.

7. RETURN AND EXCHANGE OF PRODUCTS

7.1. THE RIGHT TO WITHDRAW FROM THE CONTRACT WITHIN 14 DAYS

The Buyer (consumer) has the right to withdraw from the contract within 14 days without giving a reason. The term is counted from the day on which the Buyer or a person indicated by them received the product.

The Buyer notifies of withdrawal from the contract by email to info@gamebound.lt or by filling in the model withdrawal form (attached at the end of this document).

The returned product must be undamaged, must not have lost its merchantable appearance, must be in the original undamaged packaging and with all accessories.

Return costs are paid by the Buyer, except in cases where a faulty or wrong product is being returned.

The Seller refunds the money paid (including the price of the cheapest delivery) no later than within 14 days of receiving the notice of withdrawal from the contract. The Seller has the right not to refund the money until it has received the product or proof of its dispatch.

7.2. EXCEPTIONS

The right to withdraw from the contract does not apply to:

sealed products which were unsealed after delivery and which are unsuitable for return for health protection or hygiene reasons;
audio or video recordings, software in sealed packaging, if the packaging was damaged;

COLLECTIBLE CARD PACKS (BOOSTER PACKS)

For opened collectible card packs the right to withdraw from the contract REMAINS. The exceptions listed above do not apply to them: cards are neither a hygiene product, nor a carrier of audio, video or software.

However, in accordance with the provisions of the Civil Code on the consumer's liability for the diminished value of the product, the refunded amount may be reduced by as much as the value of the product has diminished due to handling beyond what is necessary to establish the nature and characteristics of the product. Once a pack is opened and its contents are known, the value of the pack as an unopened one is lost.

In practice this means: we accept an opened pack, but we refund the amount corresponding to the remaining value of the product. An unopened pack we refund in full.

7.3. FAULTY PRODUCTS

Having noticed a defect in the product, the Buyer contacts us by email at info@gamebound.lt and attaches the order number and photos.

The consumer has a statutory 2 (two) year guarantee: if the product does not conform to the contract, the Buyer has the right to demand repair of the product, its replacement, a price reduction, or termination of the contract and a refund. The consumer exercises this right free of charge.

The Seller replies to a claim within 14 days.

8. LIABILITY

8.1. The Buyer is responsible for the correctness of the data provided and for keeping their login details safe.

8.2. The Seller is not liable for information provided on the websites of other companies, even if the Buyer reaches them through links on the Seller's website.

8.3. If damage arises, the party at fault compensates the other party for direct losses in the manner established by the legal acts of the Republic of Lithuania.

9. PERSONAL DATA

9.1. The Seller processes the Buyer's personal data in accordance with the Privacy Policy published at www.gamebound.lt/privatumo-politika.

9.2. Marketing messages are sent only after receiving separate consent from the Buyer. Consent may be withdrawn at any time.

10. FINAL PROVISIONS AND DISPUTE RESOLUTION

10.1. The relations established by these Terms are governed by the law of the Republic of Lithuania.

10.2. All disagreements are settled by negotiation. Requests are submitted by email to info@gamebound.lt; a reply is provided within 14 days.

10.3. If the Seller's reply does not satisfy the Buyer, the consumer has the right to apply to the authority handling consumer disputes out of court:

10.4. The consumer also has the right to go to court.
